Could a strike by ramp agents give rise to compensation ?
You should know that at an airport, not all positions have the same employer. Indeed, this differs on a case by case basis, to know whether the people who are striking are employed by the airline or not, in order to be able to claim compensation of up to 600 euros, in the event of a canceled, delayed, or resulting denial of boarding, according to European Union Regulation EC No. 261/2004.
The ramp attendants’ strike :
The ramp agents (flight preparer) are there to guide the pilots, and to ensure the proper functioning of traffic on the tarmac. They are responsible for establishing routes for planes, to help them follow the route to take during takeoff and landing, and to chock the wheels once the plane has landed.
They often work on the slopes, whatever the weather, and have staggered and variable hours. Which is to blame for their strikes, in general.
Depending on the case, these agents may be employed by the airport, or the company, or subcontracted by it. In these cases, where they are under its responsibility, it is obliged to provide support (even if it is not responsible) and financial compensation to its passengers.
Passenger rights in the event of a strike by ramp agents :
If your flight is canceled or delayed, or you are refused boarding following a ramp attendant strike, even if the company is not responsible for them, it has an obligation to assist you by providing the following services:
- Offer you meals and drinks while you wait at the airport.
- Allow you to communicate with your loved ones (2 email or telephone communications)
- Take you on another flight to reach your destination, or reimburse you for the ticket, if you decide to forgo the flight.
- Accommodate you if your flight is postponed until the next day and take you to your hotel.
- Compensate you : €250 (for a flight of less than 1500 km), €400 (for a flight between 1500 km and 3500 km), and €600 (for a flight of more than 3500 km).
Claiming compensation :
If your flight is canceled, delayed by more than 3 hours, or you are refused boarding, or you have missed your connection due to a strike by ramp agents, who are the responsibility of the company . Start by contacting them, using their email address, online form, postal mail or via customer service telephone lines, to request your right to compensation.
Please be aware, however, that the majority of passengers who want to submit their requests themselves never receive responses or are plunged by carrier services into tedious and never-ending formalities. It is for this reason that several legal companies have launched into this field, to meet the needs of these victims.
their services are free until the case is won, where they take on average 25% of the amount paid by the company, as charging costs.
