Aeromexico flight delay: What to do to obtain your compensation?
By filling out the integrated form: Recover your compensation
It provides passengers with financial compensation and other benefits. Under Regulation 261/2004 EC, airlines operating in the European Union, such as Aeromexico, are required to compensate their passengers in the event of delays attributable to their responsibility.
Eager passengers stand in the crowded airport lobby, waiting for their Aeromexico flight to be posted. They discuss their upcoming trip, some checking their documents, others already dreaming about their destination. Suddenly, an announcement sounded, attracting everyone’s attention. To their surprise, they learn that their flight is delayed.
No passenger likes to be delayed, given the potentially serious consequences this entails. The repercussions of a delayed flight can range from simple inconveniences to major disruptions to travel plans. Some in the crowd begin to worry about missed connections, important meetings planned, or family events they were hoping to attend.
Even in this difficult context, there remains a bit of optimism for travelers. Passengers are protected by specific rights that can alleviate their frustration. First of all, they are entitled to basic services at the airport. This implies that the airline concerned, such as Aeromexico in this example, must provide drinks, food, and sometimes accommodation, depending on the length of the wait
The right to compensation
Next, and importantly, travelers can receive monetary compensation. It is a form of compensation, which depends on the regulations in force, varies according to the length of the delay and the distance of the flight.
Becoming aware of these rights can provide delayed passengers with welcome relief in an otherwise anxiety-provoking situation.
In the ledger of compensation rules established by the European Parliament, travelers can pocket up to €600 for flight delays of more than three hours or cancellations. But if it’s a small delay or a short flight, the amount is less generous.
For a distance of less than 1500 km, you could be awarded 250 euros as compensation
If you are somewhere between 1,500 and 3,000 kilometers, you could get around €400 in compensation
If you fly for a distance of more than 3,500 kilometers, compensation could go up to 600 euros.
Claim your compensation
However, certain situations exclude passengers from the right to compensation in the event of an Aeromexico flight delay. Two of the main reasons for ineligibility are:
Departure airport outside the EU: Regulation (EC) No 261/2004 does not apply to flights whose departure airport is outside the European Union, unless the flight is operated by a European airline, and is not the case for the Mexican airline. Therefore, if your flight with this operator was delayed from Mexico City or another city outside the EU, it is unlikely that you will be able to claim compensation under this regulation.
Occurrence of exceptional situations: These are circumstances that can release the airline from the obligation to pay compensation in the event of a flight delay. These circumstances include unforeseen and unavoidable events such as extreme weather conditions, airport staff strikes, security issues, air traffic disruptions, etc.
Claiming compensation: The little-known challenges for travelers
Eager to take steps to claim compensation in the event of a delayed flight, passengers must face several obstacles imposed by airlines. One of the main challenges is the lack of transparency regarding passenger rights and complaints procedures, with some airlines failing to provide adequate information to travelers, leaving them in the dark.
The intervention of air law experts
Legal experts are familiar with applicable laws and regulations, enabling them to advise passengers on their rights in an accurate and professional manner. They are able to take responsibility for the file from start to finish.
Added value: A good number of passengers are often hesitant to claim their compensation through these startups. However, appealing to them has a considerable advantage: in the event of failure, no costs are incurred for the applicants.
